- The rules and regulations below outline the right and duties of Users of the Service www.cwoffice.pl („Service”).
- The administrator of the Service is Cushman & Wakefield Polska Sp. z o.o. with its registered office at Plac Piłsudskiego 1 in Warsaw (00-078), registered in the District Court in Warsaw, XII Commercial Division with the number: KRS 0000039711, share capital PLN135 588.
- The Service www.cwoffice.pl provides information on the property market and commercial information related to the services offered by Cushman & Wakefield Polska Sp. z o.o.
- The services provided by the Service include: (i) presentation of current property sales or leasing offers available through the Administrator, with a direct enquiry option, (ii) the possibility of downloading informative materials on property market, (iii) the possibility of ordering agency services or submitting other instructions (iv) advertising services, which may be ordered by third parties, in the form of banners, sponsored articles or otherwise, available in the current offer.
- The Administrator stipulates that advertisements and announcement published in the Service do not represent a binding offer in the understanding of the relevant provisions of the Civil Code. The Administrator is not liable for the form and content of the promotional materials of the third parties.
- Access to the Service is restricted to registered users and some services may be blocked.
- Setting up an account is made according to the procedures described in the relevant parts of the Service and it requires having an active e-mail account.
- The Administrator may refuse to set-up an account and cancel the registered account for any reason.
- The prices for advertising services through the Service are contract prices, subject to negotiations each time and the Administrator may refuse to provide advertising services for a given entity for any reason.
- Ordering of advertising services is made by submitting filled order form, signed by the representative of ordering party.
- Advertising service will not be available unless the whole agreed payment is received.
- The third party ordering advertising services is responsible for the content and reliability of announcement and the rights and materials used for promotion in the Service, which cannot be contrary to law ethical norms or good trade practice binding in Poland. The Administrator has the right to verify those rights and content and to request the client to make corrections or provide relevant authorisation, and unjustified refusal may constitute the base for cancellation of the provision of the services in all or in part without the possibility to claim damages thereto by the client. At the same time the Administrator reserves the right to edit content and materials provided by the client at its own discretion.
- The entities promoting their services through the Service agree to make contact data public to enable identification of the advertiser.
- The Client is obliged to update data and information contained in promotional materials to reflect the actual state, otherwise the provision of the advertising services by the Administrator will be cancelled in all or in part.
- The Administrator is liable exclusively for the proper operation of the Service to the extent to which the Administrator is able to control and manage it. It is not liable, and they shall not be made the basis for any claim, for other events or occurrences which are beyond the control of the Administrator, in particular with regard to the proper operation of the Service, the Internet, unauthorized interference with the resources of the Service by third parties etc. The Administrator makes its best efforts to promptly remove any inconveniences, however, it is not liable for the loss of the Service's data collected in the Administrator's computer system, resulting from equipment, system or Internet failure, and for the loss caused by third persons' activities etc.
- The Administrator reserves its right to alter, limit or discontinue the Service in order to improve it, add content, repair or maintain it without notice.
- The Internet sites of the Service requires the use of cookie technology. Cookies files are test files which are uploaded to the computers of the Service's visitors in order to save information and data related the use of the Service by the users.
- Any matters connected with the operation of the Service and all complaints should be send through the post to the Administrator's address or by e-mail: poland.office@eur.cushwake.com.
- By accepting this Rules and Regulations the advertiser agrees to the use of the provided data in accordance with the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws, no. 133, item 833, as amended) and to receive by electronic mail commercial information in accordance with the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws, 02.144.1204).
